01Why do I need a real estate lawyer?

Real estate lawyers oversee the process of buying, selling or refinancing property to ensure your interests and rights are preserved. Closings are complicated legal processes involving many documents with significant financial implications, and legal searches are necessary to protect you from unwelcome surprises.

02What is title insurance?

An insurance policy protecting property owners and their lenders against losses related to the property's title or ownership. A lawyer can only give an opinion to the extent that a survey is correct, government search records are accurate and up to date, and there has been no fraud in the public records.

03Are first-time home buyers entitled to any benefits?

First-time buyers are entitled to a Land Transfer Tax refund of up to $4,000, meaning eligible homebuyers in Ontario pay no land transfer tax on the first $368,000 of the purchase price.

04Can I take money out of my RRSP to buy a home?

Under the federal Home Buyers' Plan you can use up to $60,000 of your RRSP savings, or $120,000 for a couple, towards a down payment. 05Do I need to arrange home insurance?

For a property that is not a condominium, home insurance is required and you must give your lawyer a copy of your fire insurance binder - the mortgage lender will not advance funds without proof of fire insurance. For a condominium you may want content insurance instead.

You are a non-resident if you have lived in Canada for fewer than 183 days in the year, or if you have no residence in Canada and customarily live outside it. A person who is not a Canadian citizen is a non-resident if they normally live outside Canada or are outside Canada more than 183 days in a year.

07I am not a Canadian resident. What happens when I sell my property?

Contact the office as early as possible. You will need to apply for a non-residency clearance certificate through an accountant, and usually 25% of the gross sale price is held, normally by the seller's lawyer in trust, until the clearance is issued.

The process by which the courts formally accept a will, or appoint someone to act where there is no will. It verifies that the testator has died, that they authored the will and that the will is valid, and gives the executor or administrator authority to administer the estate.

09How long does probate take?

It typically takes about three months for an application to be seen by the courts, and the whole process can take up to a year, longer if the will is challenged. In Ontario the executor must submit an Estate Information Return within 90 days of being appointed.
